Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kukuda platform, operated by Kukuda Labs GmbH ("Kukuda", "we", "us"), a company registered in Germany. By creating an account you agree to these Terms.

1. The Service

Kukuda provides an AI visibility infrastructure platform including Share of Voice tracking, JSON-LD schema generation, llms.txt hosting, Google Business Profile sync, and related analytics tools. We reserve the right to update, modify, or discontinue features with reasonable notice.

2. Account

You must be 18 years or older and have legal authority to bind the business you represent. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@kukuda.ai if you suspect unauthorized access.

3. Subscription and Payment

Paid plans are billed monthly in advance via Stripe. All prices are in EUR exclusive of applicable VAT. You authorize Stripe to charge your payment method on a recurring basis until you cancel. We reserve the right to update pricing with 30 days' written notice; continued use after the notice period constitutes acceptance.

4. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Your access continues until the end of the current billing period. We do not provide refunds for partial billing periods. If we terminate your account for breach of these Terms, no refund is owed.

We reserve the right to suspend or terminate accounts in violation of these rules without prior notice.

6. Intellectual Property

Kukuda and its licensors retain all rights, title, and interest in the platform, including all software, algorithms, AI models, and design elements. You retain ownership of your business data submitted to the platform. You grant Kukuda a limited license to process your data solely to provide the service.

7. Service Availability

We target 99.5% monthly uptime. Planned maintenance is announced at least 24 hours in advance on our status page. We are not liable for downtime caused by circumstances beyond our reasonable control, including third-party API outages (Google, OpenAI, etc.) or force majeure events.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Kukuda's aggregate liability arising out of or related to these Terms is limited to the total fees paid by you in the three months immediately preceding the claim. We expressly exclude liability for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or business opportunity.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under German law.

9. Governing Law and Jurisdiction

These Terms are governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For disputes with business customers (B2B), the courts of Berlin shall have exclusive jurisdiction.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Your continued use of the platform after the notice period constitutes acceptance of the updated Terms.
